These Terms of Service (“Terms”) govern your access to and use of HomePilot’s website at homepilotmortgage.com, our borrower portal, and any related services we provide (collectively, the “Services”). HomePilot is a licensed mortgage broker operating under NMLS ID 2752340. By using the Services you agree to these Terms.
1. Eligibility
You must be at least 18 years old, a U.S. citizen or legal resident, and able to enter a binding contract under the laws of your state to use the Services. The Services are intended for use in jurisdictions where HomePilot is licensed; use of the Services outside those jurisdictions does not create a brokerage relationship.
2. What HomePilot does and does not do
HomePilot is a mortgage broker. We help borrowers shop residential mortgage loans across our wholesale lender partners and submit applications to those lenders for underwriting and approval. We do not lend money, fund loans, or service loans after closing.
Rate quotes are not loan commitments.Any rate, fee, payment, or APR shown on the website, in the rate ticker, in a saved quote, or otherwise communicated outside a signed loan commitment is illustrative only. Final pricing depends on underwriting, lock timing, property appraisal, title results, credit report, income and asset verification, and the lender’s published guidelines. A binding commitment to lend exists only when a lender issues one in writing.
3. Your account and the borrower portal
You are responsible for the accuracy of the information you submit and for keeping your login credentials confidential. Notify us immediately at hello@homepilotmortgage.com if you suspect unauthorized access to your account or if your email or phone number changes.
You agree that information you provide on the URLA (Form 1003) and elsewhere in the Services is true and complete. Federal law (18 U.S.C. § 1014) makes knowingly false statements on a mortgage application a federal crime.
4. Authorization to obtain consumer reports
By submitting an application or requesting a credit-pulled rate quote, you authorize HomePilot and its lender and verification partners to obtain consumer credit reports, employment and income verifications, asset verifications, and identity- and fraud- screening reports about you, including soft and hard inquiries as applicable to your request.
5. Electronic communications, signatures, and disclosures (E-SIGN)
By creating an account, requesting a quote, or submitting an application, you consent under the federal Electronic Signatures in Global and National Commerce Act (15 U.S.C. § 7001 et seq., “E-SIGN”) and applicable state law to:
- Receive Loan Estimates, Closing Disclosures, adverse-action notices, change-in-circumstance redisclosures, privacy notices, and other federal and state disclosures electronically.
- Receive marketing and servicing communications by email, phone, and SMS, including by automated dialing systems, at the contact information you provide. Carrier message and data rates may apply. You can revoke this consent at any time by replying STOP to a text or contacting us.
- Sign documents using electronic-signature technology, which we treat as the legal equivalent of a wet-ink signature.
To receive electronic disclosures, you need an internet-connected device with a modern browser, an active email account, and the ability to view and save PDFs. You may withdraw consent or request paper copies by contacting us; doing so may slow your loan-application timeline or, for some processes, prevent HomePilot from continuing to provide Services electronically.
6. Permissible use
You agree not to:
- Submit information that you know to be false or misleading, including impersonating another person or making a fraudulent loan application.
- Use the Services on behalf of someone else without written authorization.
- Scrape, copy, or republish content (including rate quotes, ladders, or LLPA tables) for redistribution or commercial use without our written permission.
- Probe, scan, or interfere with the integrity or performance of the Services, attempt to bypass authentication, or upload malicious code.
- Use the Services in violation of any law, including federal and state mortgage, fair-lending, anti-discrimination, anti-fraud, tax, and consumer-protection laws.
7. Equal Credit Opportunity Act and Fair Housing
HomePilot complies with the Equal Credit Opportunity Act (15 U.S.C. § 1691 et seq.) and the Fair Housing Act. We do not discriminate against you on the basis of race, color, religion, national origin, sex, marital status, age, the receipt of public-assistance income, or because you in good faith exercised any right under the Consumer Credit Protection Act. The federal agency administering compliance for HomePilot is the Consumer Financial Protection Bureau, 1700 G Street NW, Washington, DC 20552.
8. Intellectual property
All content on the Services (including text, graphics, logos, UI, software, and rate-engine output) is owned by HomePilot or its licensors and is protected by U.S. and international intellectual-property laws. We grant you a limited, non-transferable, non-exclusive license to use the Services for the purpose of obtaining and managing a residential mortgage loan through us. We reserve all other rights.
9. Third-party services
The Services may link to or integrate with third-party services (lenders, credit bureaus, e-signature providers, payment processors, analytics, and government sites). Those services are governed by their own terms and privacy policies; HomePilot is not responsible for them. Your use of a third-party service is at your own risk.
10. Disclaimers
EXCEPT AS EXPRESSLY STATED IN A SIGNED LOAN COMMITMENT FROM A LENDER, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. HOMEPILOT DOES NOT WARRANT THAT RATE QUOTES, ELIGIBILITY DETERMINATIONS, AUS DECISIONS, OR ANY OTHER OUTPUT WILL MATCH THE FINAL TERMS OFFERED BY A LENDER.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMEPILOT, ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, LOST OPPORTUNITY, OR DAMAGES FROM A FAILURE TO LOCK A RATE — ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS IS LIMITED TO THE GREATER OF (A) THE FEES YOU PAID HOMEPILOT IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (B) ONE HUNDRED U.S. DOLLARS ($100). SOME STATES DO NOT PERMIT THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; THESE LIMITS APPLY ONLY TO THE EXTENT PERMITTED BY YOUR STATE.
12. Indemnification
You agree to defend, indemnify, and hold harmless HomePilot and its affiliates, officers, employees, and agents from any claim, liability, damage, loss, or expense (including reasonable attorneys’ fees) arising out of (a) your use of the Services, (b) information you submit that is false, inaccurate, or infringes a third party’s rights, or (c) your violation of these Terms or applicable law.
13. Governing law and venue
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules, except that any mandatory consumer-protection or financial-services law of your state of residence will apply where required by that state. The exclusive venue for any dispute that is not subject to the arbitration provision in Section 14 is the state and federal courts located in Maricopa County, Arizona, and you consent to personal jurisdiction in those courts.
14. Dispute resolution
We hope to resolve any concern informally. Please contact us at hello@homepilotmortgage.com so we can attempt to resolve the issue before any formal action.
If we cannot resolve the dispute informally, both parties agree that any dispute arising out of or relating to these Terms or the Services that is not resolved within 60 days of written notice will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitrator’s decision is final and may be entered as a judgment in any court of competent jurisdiction. You and HomePilot waive the right to a jury trial and the right to participate in a class action. This arbitration agreement does not prevent either party from filing a small-claims action where eligible, or from raising any claim, defense, or remedy required by federal or state law that cannot be waived (including claims under the Consumer Financial Protection Act).
15. Termination
You may stop using the Services at any time. We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law, or if continuing the relationship would create undue risk to HomePilot or other users. Sections that by their nature should survive (including Sections 8, 10, 11, 12, 13, 14, and 17) will survive termination.
16. Changes to the Services and these Terms
We may modify the Services or these Terms at any time. If a change is material, we will give reasonable notice (e.g., by email or a notice on the site) before the change takes effect. Your continued use of the Services after the effective date constitutes acceptance of the revised Terms.
17. Miscellaneous
These Terms, together with our Privacy Policy, our state-licensing disclosures, and any signed loan documents, are the entire agreement between you and HomePilot regarding the Services. If any provision is held unenforceable, the rest of these Terms remain in effect. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms; we may assign them to a successor in connection with a merger, acquisition, or sale of assets.
